Valutazione Rischi obbligatoria dal 2009

has slipped from 29 July 2008-1 January 2009, the deadline for drafting the document, risk assessment, required by Decree 81 2008 introducing the Consolidated Act on the protection of health and safety in the workplace.

The extension is contained in the bill for the conversion of DL June 3, 2008, No 97 "Urgent provisions for monitoring and transparency mechanisms for allocation of public expenditure and taxation matters and the extension of the term" already approved by the Senate. The measure changes l’art. 306, comma 2, del Dlgs 81/2008 prorogando il termine: “a decorrere dal 1ยบ gennaio 2009”. Il termine riguarda l’entrata in vigore delle disposizioni di cui agli articoli 17, comma 1, lettera a), e 28 del Dlgs 81/2008, e delle altre disposizioni in tema di valutazione dei rischi, comprese le relative sanzioni.

La valutazione dei rischi attiene a "tutti i rischi per la sicurezza e la salute dei lavoratori, ivi compresi quelli riguardanti gruppi di lavoratori esposti a rischi particolari, tra cui anche quelli collegati allo stress lavoro-correlato, secondo i contenuti dell'accordo europeo dell'8 ottobre 2004, e quelli riguardanti le lavoratrici in stato di gravidanza, secondo quanto Legislative Decree 26 March 2001, No 151, as well as' those related to gender, age, from other countries.

The employer is required to assess any risks to safety and health of workers, including those related to work stress, those relating to workers who are pregnant and those related to gender differences , age, from other countries.


In converting Decree Law 97/2008 also merge some of the measures contained in Decree Law 113 of June 30, 2008 "Extension of deadlines set by laws, in particular ' Article 4-bis Section 10 provides for the extension to June 30, 2009 deadline for completing the adjustment to the rules of fire prevention by tourism and hotel accommodation with 25 beds that have already submitted by June 30, 2005 request clearance to the Fire Department.
